What FTC rule are these based on?
They reflect the FTC’s pricing-transparency expectations under Section 5 of the FTC Act. (The CARS Rule was vacated by the 5th Circuit in January 2025 and is not in effect.) The readiness check maps to the six pricing practices the FTC named in its March 13, 2026 warning letters to 97 auto dealer groups.
Which fees have to be in my advertised price?
The FTC’s rule of thumb: if a customer can’t walk out without paying it, it belongs in the advertised price. That includes doc/processing, dealer prep, electronic filing, reconditioning, “market adjustment,” freight, and any required add-on. Only government taxes and government registration/title fees may be excluded.
